2. The petitioners seek bail in connection with Excise P.S. Case No. 1498 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 122 litres of illicit liquor was recovered from the vehicle of the petitioners.
4. Learned counsel for the petitioners submits that the petitioners are innocent and has been falsely implicated in this case. The petitioners are neither concerned with the owner of the vehicle nor the wine which was kept in the vehicle. The petitioners are in jail since 17.08.2023 having clean antecedent.
5. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No.71487 of 2023(2) dt.07-11-2023 2/2 prayer for regular bail of the petitioners.
6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court No. 03, Gaya in connection with Excise P.S. Case No. 1498 of 2023.
7. The petitioners will also mark attendance in Barachatti Police Station, Gaya on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioners. (Sandeep Kumar, J) P. Kumar U T
