JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Barhaiya P.S. Case No. 59/19, disclosing offences under Sections 302, 201, 120(B)/34 of the Indian Penal Code. Prosecution case is that dead body of brother of the informant was found lying in the railway track and informant suspects the hands of petitioner and others in murder of his brother.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion as earlier the petitioner and other accused persons were the mediator in execution of sale deed and save and except that there is nothing against the petitioner. It has further been submitted that during investigation, it has come on record that while the deceased was in prison, he had a quarrel with one

Patna High Court CR. MISC. No.75680 of 2019(3) dt.20-01-2020 2/2 Gaurav Singh, who had threatened him to kill. Considering the said fact, this court vide order dated 08.01.2020 has granted the privilege of anticipatory bail to co-accused, namely, Srikant Singh vide order dated 08.01.2020 passed in Cr. Misc. No. 49681 of 2019.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barhaiya P.S.
