The petitioner is in custody in a case registered for offences punishable under Sections 341, 323, 324, 325, 308, 427, and 504/34 of the Indian Penal Code.

This is a case of abuse and assault against nine persons including the petitioner. When the family members of the informant came to his rescue, they were also assaulted and the informant and others sustained injury.

It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case. The main allegation is against Rajesh Yadav. The allegation is general and omnibus and the petitioner is in

Patna High Court CR. MISC. No.72224 of 2022(2) dt.28-02-2023 2/2 custody since 07.08.2022.

The learned Additional Public Prosecutor for the State vehemently opposed the prayer for bail.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kusheshwar Asthan P.S. Case No. 260 of 2022 to the satisfaction of the Subdivisional Judicial Magistrate, Biraul, Darbhanga. (Sunil Kumar Panwar, J) Shamshad & Alok Kr.
