2. The petitioner is apprehending arrest in connection with Kateya P.S. Case No. 393 of 2022 lodged on 03.09.2022 for offences punishable under Section 406/409/420/120B/34 of the Indian Penal Code.
3. As per the prosecution story F.I.R has been lodged against seven named accused persons with an allegation that they have committed embezzlement of money from the Mukhymantri Sat Nishchay Yojna for Year 2016-17 to 2021-22.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner has two antecedents. He further submits that petitioner has completed the work but by his unknown

Counter affidavit has been filed by the Block Development Officer in this matter intimating a report duly signed by the Committee intimating the after physical verification, the joint inquiry team has reported that work under Mukhymantri Sat Nishchay Yojna for Year 2016-17 to 2021-22 for Ward No. 1, 4 and 14 is completed as per estimated time.
5. Learned APP for the State opposes the prayer for bail and submit that from the counter affidavit, it seems that the work has been completed
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest of surrender and on furnishing bail bond of Rs. 30,000/- (Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Gopalganj subject to the condition as laid down under Section 438(2) Cr.P.C.
