The present writ application has been filed by the petitioner for a direction to the respondents to grant B.A.Trained pay scale.
The petitioner superannuated from service on 30.04.2000 and after 12 years of her superannuation, she filed the present writ application for grant of graduate trained pay scale. Apart from the inordinate delay in filing the present application, the Court finds that claim of the petitioner for grant of graduate trained pay scale is based on Intermediate as well as Graduate degree obtained from Hindi Vidya Peeth, Deoghar, such degree has been held to be inappropriate by this Court. It
Patna High Court CWJC No.23537 of 2012 dt.17-09-2018 2/2 has been held out that the degree of Hindi Vidya Peeth, Deoghar granted is only for the purpose of proficiency in Hindi and as such it is of no help to the petitioner for grant of graduate trained pay scale. Thus, in the facts and circumstances of this case, the Court does not find any reason to grant indulgence in the present writ application.
The reliance placed on Annexure-3 is also of no use as no such claim of the petitioner was adjudicated in CWJC No. 17088 of 2012. The Court granted indulgence to the petitioner to the effect that the respondent shall grant a personal or representative hearing and pass a speaking order on the claim of the petitioner.
