1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Jadopur P.S. Case no. 104 of 2023, registered under sections 302, 201 and 34 of the Indian Penal Code

3. As per the prosecution case, the informant states that a dead body with the head severed was found. The deceased appeared to be a 25 year old person who was wearing a red shirt and a blue jeans.

4. Learned counsel for the petitioner submits that the FIR was registered against unknown. The petitioner was falsely implicated in the case. There is no eye-witness to the occurrence and the trial has commenced. No material has transpired against

Patna High Court CR. MISC. No.69243 of 2023(3) dt.20-12-2023 2/3 the petitioner to connect him with the alleged crime. The petitioner is in custody since 22.5.2023 and undertakes to cooperate in the trial.

The prayer for bail is opposed by learned APP for the State who submits that in course of investigation it transpired that one Nidhi Kumari came in contact with Vishal Kumar, the deceased and they started living together. The brother of Nidhi Kumari namely Gautam was opposed to the said relationship. It has also transpired that the said Gautam was in regular touch with the petitioner herein and the murder was carried out. Learned APP further submits that the petitioner confessed to have committed the crime along with Gautam which also led to the recovery of the knife used in commission of the offence.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner and the material which has transpired in course of investigation as has been submitted by learned APP for the State, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

7. Learned trial Court is directed to expedite the trial and to conclude the same at the earliest preferably within a
