Mr. Ajay Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks regular bail in connection with Raniganj P. S. Case No. 51 of 2018 registered for the offence punishable under Section 392 of IPC.

As per F.I.R. some miscreants have intercepted the informant while he was coming by motorcycle on the point of pistol and taken away ATM Card, motorcycle and cash of Rs. 2500/-. It has further been submitted that petitioner is accused in three other cases also and the name of the petitioner also transpires on the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that name of the petitioner transpires on the confessional statement of the co-accused Md. Mojeev and said Md. Mojeev has also criminal antecedent, who has granted bail by a Coordinate Bench of this Court, vide order dated 14.11.2019

Patna High Court CR. MISC. No.70712 of 2019(3) dt.20-01-2020 2/3 passed in Criminal Misc. No. 63974 of 2019. Further submission is that he is accused for five and half months. Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that recovered motorcycle was used in the murder case earlier, for which, petitioner is an accused under Section 302 of IPC. However, he has admitted that Md. Mujeev was also accused in that case.

Having heard both sides, in view of submissions made above and as the co-accused has already been granted bail, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Araria, in connection with Raniganj P. S. Case No. 51 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area in the first week of each month for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.
