Mr.Madan Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-10-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Gaurichak P.S. Case No.443 of 2019, registered for the offences punishable u/s 30(a) of Bihar Prohibition and Excise Act, 2016.

3. Altogether 15 litres of country made liquor has been recovered and 1000 litres of Java Mahua has been destroyed at the spot.

4. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no

Patna High Court CR. MISC. No.70398 of 2024(2) dt.21-10-2024 2/2 offence. They have been falsely implicated in this case due to ulterior motive. No incriminating article has been recovered from the conscious physical possession of the petitioners. They have no concern either with the seized liquor or any trade of liquor. They were not apprehended on the spot and their name transpired in the case merely on suspicion. Petitioners have no criminal antecedent.

5. Learned APP for the State opposes the bail application by submitting that the petitioners are the members of the syndicate involved in manufacturing of illicit liquor.

6. Having regard to the facts and circumstances of the case and considering that the petitioners are involved in manufacturing of illicit liquor, I am not inclined to enlarge them on anticipatory bail. The prayer for grant of bail on behalf of the petitioners is hereby rejected.
