The petitioner is languishing in custody since 29.6.2019 in a case registered for the offence punishable under Sections 392 of the I.P.C.

The prosecution case is that robbery of Rupees One Lac Fifty Thousand and a mobile phone of the informant, was committed, leading to registration of FIR against unknown. It is submitted by learned counsel for the petitioner that no recovery has been made from the possession of the petitioner nor till date, the petitioner has been put on Test Identification Parade. Statement to that effect has been made in paragraph 10 of the petition. Though the petitioner is accused in five other cases but he is on bail in all those cases.

Learned APP submits that the petitioner has criminal

Considering the fact that the investigation has already concluded, till date the petitioner has not been put on Test Identification Parade and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Katihar in connection with Falka P.S.
