2. The petitioner seeks bail, apprehending his arrest, in connection with Sonepur P.S. Case No.691 of 2024, dated 09.08.2024, registered for the offences punishable under Sections 134 and 303(2) of BNS and later on Section 317(2) of BNS was added.

3. As per allegation, the mobile of the informant was snatched and the snatched mobile has been recovered from coaccused Aman Prasad and in whose confessional statement, the name of the petitioner has transpired as an accomplice.

4. Ld. counsel for the Petitioner submits that the Petitioner is innocent and has falsely been implicated in this case. He further submits that as per the statement of Aman Prasad, mobile was purchased by him from Chotu Kumar and

Patna High Court CR. MISC. No.67189 of 2025(2) dt.17-09-2025 2/3 when Aman Prasad had gone to the shop of Chotu for purchasing the mobile, petitioner was also along with him. He further submits that Aman Prasad has falsely implicated the petitioner in his confessional statement, on account of his previous enmity.

5. It is also stated in paragraph no. 2 of the petition that no similar petition has earlier been filed by the petitioner either before this Court or before the Hon'ble Apex Court.

6. It has further been stated in paragraph no.3 of the bail petition that the petitioner has two criminal antecedents.

7. However, Ld. APP for the State vehemently opposes the prayer of the Petitioner for anticipatory bail submitting that now a days, snatching mobiles is very serious offence because personal mobile contains various information including bank accounts and passwords of the victim. If a person is deprived of his mobile, he becomes vulnerable to various other offences. Now a days, such offence is being committed by a gang and such accused should not be enlarged on anticipatory bail. Such accused are serious threat to the society.

8. Considering the nature of the offence, I am not persuaded to enlarge the Petitioner on anticipatory bail. The bail
