This application has been filed seeking quashing of the First Information Report of Darbhanga Sadar P. S. case No. 266 of 2012 registered for the offences punishable under Sections 406,409,467,468,420 & 120B of the Indian Penal Code and Section 13(1) (c) of the Prevention of Corruption Act. I have perused the First Information Report. The allegations made therein constitute cognizable offence punishable under various Sections of the Indian Penal Code, Essential Commodities Act and Prevention of Corruption Act. The First Information Report, therefore, in such circumstance, cannot be quashed invoking jurisdiction under

Section 482 of the Code of Criminal Procedure. This application is, however, disposed of with a liberty to the petitioner to raise such plea as has been raised in the present application at the stage of framing of charge or at any subsequent stage.
