JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/379/504/506/34 and other ancillary sections of the Indian Penal Code. Prosecution case is that all the FIR named accused persons including the petitioner assaulted on account of which three persons sustained injuries. They also entered into the PDS shop and took out cash Rs. 18,000/- and 15 bags rice. Learned counsel for the petitioner submits that the petitioner is not the author of the injury which was found to be grievous in nature by the doctor. Case and counter case in which both sides sustained injuries.
Considering the aforesaid facts of the case, prayer for
Patna High Court CR. MISC. No.67048 of 2022(2) dt.04-04-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Bettiah Muffasil Police Station Case No. 342 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
