Petitioner seeks bail in a case registered under Section 370 of Indian Penal Code and Sections 3, 4, 5, 6, 7 of the Immoral Traffic Act, 1956.
Learned Senior Counsel for the petitioner submits that he has been implicated in this case at the instance of agnates of his maternal grandfather only because his mother has inherited the property from the maternal grandfather. Earlier also, petitioner and his father have been implicated in similar cases at the instance of the maternal uncle and his family members. He relies on Annexures 4 and 4A which are orders passed in the earlier case granting anticipatory bail to the father of the petitioner and regular
Patna High Court Cr.Misc. No.45137 of 2017 (2) dt.19-09-2017 2/2 bail to the petitioner by orders dated 21.10.2016 in Cr Misc No 41924 of 2016 and order dated 13.12.2016 passed in Cr Misc No 41161 of 2016. the petitioner is said to be in custody since 29.06.2017. in paragraph 3 of the petition, petitioner has mentioned the other cases in wuich he has been falsely implicated and in those cases, he is already on bail.
Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Gopalganj in Kuchaikote Police Station Case No 172 of 2017 subject to the following conditions:
(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
