2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30 (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner rather 1000 liters of soaked mahua and other utensils used in manufacturing is said to have been recovered from the place of occurrence. He has no concern either with the seized articles or the place of recovery or any trade of liquor. He has been falsely implicated in this case at the instance of suspicion. Two persons who fled away from the place of occurrence identified
Patna High Court CR. MISC. No.68854 of 2023(3) dt.25-01-2024 2/2 by local Chaukidar. Petitioner has one criminal antecedents of similar nature as mentioned in para-3 of this application.
4. Having regard to the facts and circumstances of the case, petitioner is a member of syndicate manufacturing illicit liquor and one criminal antecedent of similar nature against the petitioner, I am not inclined to enlarge him on anticipatory bail.
5. The prayer for anticipatory bail of the petitioner is hereby rejected.
