The petitioner is in custody since 31.07.2019 in connection with Special Excise Case No. 2500 of 2019 arising out of Mokama P.S. Case No. 44 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner and the petitioner has no criminal antecedent. It is further submitted that the petitioner has falsely been implicated in this case.
