The petitioner apprehends his arrest in connection with Baheri P.S. Case no. 09 of 2015, registered under Sections 447, 341, 323, 504, 307 and 379/34 of the Indian Penal Code. The accusation is that on 10.01.2015, four persons named in the F.I.R. including the petitioner started abusing to the informant Brij Kishore Yadav, when informant made protest then petitioner gave Farsa blow at his head. When Tek Narayan Yadav, son of the informant, rushed there in rescue then he was also assaulted by them. At that time, this petitioner and his son Shambhu Yadav took away box, containing cash of Rs. 30000/- and ornaments, of the informant.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.62234 of 2019(2) dt.21-10-2019 2/2 admittedly the petitioner and informant are next door neighbour and occurrence of Marpit took place due to land dispute. Further submission is that specific allegation against the petitioner is to cause Farsa blow at the head of informant, but the injuries as found on the person of informant are simple in nature. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-VIII, Darbhanga in connection with Baheri P.S. Case No. 09 of 2015 (Trial No. 1474 of 2019), subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
