That this is an application for issuance of a Writ in the nature of Mandamus commanding and directing the Respondent authorities, specially Respondent No. 4 i.e. Circle Officer, Shivaji Nagar, Samastipur to remove the encroachment made by some of the persons upon the public land pertaining to Khata No. 288 Khesra No.

940 situated in Mauza- Shankarpur, Thana No. 41, P.S- Rosera, Anchal Shiva Jagar, District- Samastipur, total

Patna High Court CWJC No.14653 of 2023(2) dt.30-04-2024 2/2 area measuring about 99 decimals of Government/Public land which was being used by the people of the locality for public purposes, but some of the antisocial elements in connivance with the public officials not only encroached the public land but also constructed some illegal construction over the land and are trying to grab the land. Against that the District Magistrate after due enquiry issued direction for removal of the illegal encroachment but despite clear direction the Respondent No. 4 is sitting tight over the matter."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Samastipur, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

Accordingly, the present writ petition stands disposed off.
