JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 13-10-2025 This case has been listed under the heading 'To Be Mentioned' praying therein that vide earlier order dated 08.10.2025 wherein the petitioners were granted bail but due to inadvertence, the same has been adjourned for 09.10.2025.
2. Therefore, the order dated 08.10.2025 be read as Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners are in custody in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
4. As per the allegation in the FIR, 21 cartoons containing 491 bottles each of 375 ml, total 184.125 litres of Indian made foreign liquor has been seized from a Scorpio bearing Registration No. BR-10PA-9414.
5. Learned counsel for the petitioners submit that
Patna High Court CR. MISC. No.70429 of 2025(3) dt.13-10-2025 2/2 petitioners have falsely been implicated in this case. He further submits that no incriminating article has been recovered from the conscious possession of the petitioners, no any independent eye witness has supported the prosecution story except the police officials. He next submits that petitioners are in judicial custody since 26.08.2025 and Petitioner No.1, namely, Dhananjay Das @ Dhananjay Kumar has got one criminal antecedent and Petitioner No.2, namely, Titlesh Kapri has got clean antecedent as stated in para-3 of the bail petition.
6. However, learned APP for the State opposes the prayer for regular bail of the petitioners.
7. Considering the above facts and circumstances of the case and submission of learned counsel for the petitioners, let the above named petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-1, Bhagalpur in connection with Excise(Sadar) P.S.
