JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Sultanganj P.S. Case No. 240 of 2017 dated 20.07.2017 instituted for the offences under Sections 406, 420, 341, 323, 504, 506, 147, 149 of the Indian Penal Code.

The petitioners are said to have purchased a plot of land which was earlier purchased by the informant from the same vendor.

Learned counsel appearing for the petitioners has submitted that petitioners have only been duped as the land which had already been sold was again sold to them. There is nothing on record to suggest any complicity between the

Patna High Court Cr.Misc. No.15714 of 2018 (2) dt.05-04-2018 2/2 vendor and the petitioners for defrauding the informant. Considering the fact that petitioners have purchased the land after paying full consideration amount to the vendor, which earlier was sold to the informant, this Court is inclined to grant anticipatory bail to the petitioners. The petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, are directed to be released on anticipatory bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bhagalpur in connection with Sulganganj P.S. Case No. 240 of 2017.
