JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Amarpur (Phuli Dumar) P.S.Case No. 357 of 2016 registered under Sections 147, 148, 149, 302 and 506 of the Indian penal Code and Section 27 of the Arms Act. .
Allegation in brief is that all the FIR named accused persons caught hold the informant and her father-in-law and on instigation of Dayanand Panjiara, Anil Panjiara shot on the head of her fatherin-law, Nawal Panjiara shot at his back, thereafter Dilip Panjiara and Jagdambi Panjiara also shot at him as a result he died. Submission is that all family members have been implicated but there is no specific allegation against these petitioners of resorting to fire or doing any overt act and similarly situated other
Patna High Court Cr.Misc. No.12275 of 2018 (2) dt.28-02-2018 2/2 co-accused persons Subodh Yadav and Others have been admitted to bail by a co-ordinate Bench of this Court vide order dated 20.03.2017 passed in Cr. Misc. No. 11686 of 2017 and the petitioners are in custody since 20.09.2017.
Having considered the aforesaid facts and circumstances, the petitioners, namely, Suraj Panjiara, Nandu Panjiara and Julmi Panjiara @ Julum Panjiara @ Julmi, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur (Phuli Dumar) P.S. Case No. 357 of 2016, with condition that one of the bailor must be their close family members. Petitioners shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, their bail bond shall be liable to be cancelled.
