The petitioner apprehends his arrest in Kasim Bazar P.S. Case No.139 of 2019 registered under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act.

The recovery was made from a bush situated in open field. The informant alleged that he got information that it was petitioner, who kept liquor in the field.

Learned counsel for the petitioner submits that the petitioner has got no manner of concern and there is no tangible material to show that the petitioner had kept liquor in the field of Triloki Das and Raju Das.

Having considered the facts aforesaid and the fact that nothing has been recovered from possession of the petitioner,

No.62598 of 2019(2) dt.17-10-2019 2/2 the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III-cum-Special Judge (Excise), Munger in connection with Kasim Bazar P.S. Case No.139 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
