The petitioner seeks bail in connection with Paharpur P.S. Case No.175 of 2019 registered under Sections 302/34 of the Indian Penal Code.

The accusation is that 4 persons, named in the F.I.R., including the petitioner and two unknown entered into the house of the informant. At that time, Vivek Giri, son of Srikant Giri, and Vivek Giri, son of Jaishankar Giri, threatened the informant and others, asking them to keep silent. Thereafter, Vivek Giri, son of Srikant Giri caught hold of them and Vivek Giri, son of Jaishankar Giri, gave the knife blow at the chest of Deepanshu, the brother of the informant, causing injury to him. Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act is attributed to him. The petitioner has no criminal antecedent and is in custody since 07.06.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Paharpur P.S. Case No.175 of 2019.
