2. The petitioner is in custody in connection with Bhagwanpur P.S. Case No. 163 of 2024 for the offence punishable under sections 420, 409, 406, 467, 468 and 471 of the Indian Penal Code lodged on 07.06.2024 by the informant, Rahul Kumar.
3. As per the prosecution story, the informant lodged the FIR alleging that the finance company, "Spandra Asfunti Financial Company Ltd. Bhagwanpur Branch" on the basis of forged documents, altogether sixty two loans were distributed. During the audit, the same came to the notice and later, it was also found that the accused persons prior to it used to take the documents/Aadhar card of the college going girls and misused the same for their benefits. Patna High Court CR. MISC. No.72465 of 2024(2) dt.22-10-2024 2/2 both Niwas Kumar and Nitish Kumar (petitioner herein) have altogether misappropriated Rs. 28,54,505/-. Accordingly, the FIR.
4. Though the learned counsel for the petitioner submits that it is purely a civil dispute, learned APP has pointed out that beside the misappropriation of fund, there is allegation of misusing the IDs of the unmarried/college going girls and opening false bank accounts in their respective names.
5. The allegation is grave, in that background it is not proper for the present to extend the benefit of bail to the petitioner.
