JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-04-2018 The petitioner is apprehending his arrest in connection with Konch P.S. Case No. 212 of 2017, registered for offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegation against the petitioner that he along with others committed loot of Rs. 3 lacs from the informant and also of assaulted him.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name surfaced during course of investigation on the confessional statement of co-accused and except that there is nothing against the petitioner and he has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.15344 of 2018 (3) dt.20-04-2018 2/2 circumstances and the allegation levelled against the petitioner, I am not inclined to grant the privilege of anticipatory bail to him, this application is accordingly dismissed.
If the petitioner so desire may surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available on record. (Vinod Kumar Sinha, J) sunil/- U T
