JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Rajepur P.S.Case No. 108 of 2016 registered under Sections 393 of the Indian penal Code and Section 27 of Arms Act. Allegation in brief is that three unknown miscreants made an attempt to loot the motorcycle of the informant but failed in attempt.

Submission is that petitioner was not put on TIP and implicated in this case only on the basis of disclosure of his name in the confessional statement of Santosh Kumar Rai, who has been admitted to bail by a co-ordinate Bench of this Court vide order dated 20.03.2017 passed in Cr. Misc. No. 7441 of 2017, moreover, this petitioner has no criminal antecedent.

No.12265 of 2018 (2) dt.28-02-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Sumir Sahani @ Sumit @ Kachhua, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar at Motihari East Champaran in connection with Rajepur P.S. Case No. 108 of 2016.
