The petitioners apprehend their arrest in Sasaram(Muffasil) P.S. Case No.278 of 2018 registered under Sections 341, 323, 307, 34 of the Indian Penal Code. The informant in sum and substance alleged that while she has gone to pick cow dung, Sosil Singh, Sonu Singh, Balgeet Singh, Hira Lal Singh, Munna Singh and Mahendra Singh surrounded her and Sosil Singh assaulted her with spade on her head. When her husband Krishna Sah and brother-in-law, Lallu Sah came to save, the accused persons also assaulted them.

The learned counsel for the petitioners submits that there is a counter version being Sasaram Muffasil P.S. Case No.277 of 2018. It is further submitted that informant,

Patna High Court CR. MISC. No.68482 of 2019(2) dt.08-11-2019 2/2 Kaushalya Devi got one lacerated wound which is simple in nature caused by hard and blunt object. Lallu Sah got as many as four injuries which are superficial and simple in nature. There appears that there is a case and counter case and on account of land dispute, both sides engaged in assault with each other but the injuries found on the informant and her brother-in-law are simple in nature. It is submitted that husband of the informant did not receive any injury and Keshma Devi received tender red swelling injury on her wrist.

Taking into consideration the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram in connection with Sasaram(Muffasil) P.S. Case No.278 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
