2. The petitioner apprehends his arrest in connection with Buxar Excise P.S. Case No. 93 of 2025, registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

As per the first information report, a police team in course of checking of vehicles coming from Uttar Pradesh, intercepted one three-wheeler Bajaj Auto, bearing Registration No. BR-44P-6029, and, on search, 216 liters of country made liquor was recovered and the driver was apprehended. The illicit liquor and the three-wheeler were seized.
4. Learned counsel for the petitioner submits that the seized liquor to the tune of 216 liters was recovered from Bajaj Auto of which the petitioner was owner and prior to the alleged incident, the said vehicle was sold out to one Pooja Devi and the
Patna High Court CR. MISC. No.66187 of 2025(2) dt.24-09-2025 2/3 sale agreement executed between them transferring the ownership to Pooja Devi is appended with the petition. He further submits that the police had sought the assistance of the petitioner for carrying out the investigation and the petitioner has submitted of the documents before the police and thereafter was released, but on the basis of cognizance taken by the learned Special Court, this petitioner apprehends arrest in the said case and accordingly he has preferred this anticipatory bail application. It has next been submitted that the petitioner has five criminal antecedents against him and he is on bail in all the cases and none of the case is of present nature and the petitioner's primary source of livelihood is his profession of electrician.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-2, Buxar, in connection with Buxar Excise P.S. Case No. 93 of 2025 subject to the condition as laid down under Section 482
