This writ application, filed on behalf of the petitioners, under Article 227 of the Constitution of India, is directed against the order dated 03.08.2012 passed in Title Suit No.129 of 2009, whereby the Munsif, Kaimur at Bhabua allowed the application dated 26.04. 2012 filed on behalf of the plaintiff-respondent to appoint the Survey Knowing Pleader Commissioner for measurement of the land in dispute.

3. On going through the impugned order, I find no illegality therein amounting to abuse of the process of the court for
