The petitioner is languishing in custody for the offences punishable under Sections 342/223/224/34 of the Indian Penal Code, Section 13(2) of the P.C. Act, Section 3(2) (ii) of the SC/ST Act and Section 50(c) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that the petitioner and other co-accused fled away from the police station in collusion with the constable on duty.

Similarly situated co-accused Mangal Singh has already been allowed bail by a coordinate Bench of this Court. There is no case of tampering with the evidence. Investigation

Patna High Court CR. MISC. No.66140 of 2019(4) dt.18-12-2019 2/2 of the case is already complete.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with NTPC Khaira P.S. Case No.32 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
