JUSTICE BIRENDRA KUMAR ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 353, 332, 333, 337, 338, 427, 504 and 506 of the Indian Penal Code.
According to FIR, murder of a co-villager was committed by some unknown person, for that reason a crowd had blocked the road traffic and allegedly scuffled with the police party and obstructed in discharging of their official duty. The petitioners were identified as amongst the members of the crowd.
Patna High Court Cr.Misc. No.44677 of 2017 (2) dt.19-09-2017 2 /2 Submission of learned counsel for the petitioners is that there is only suspicion against the petitioners, they have no criminal antecedent and there is no specific allegation against the petitioners.
Considering the aforesaid facts, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Samastipur/successor Court in connection with N.H. Bangra P.S. Case No.63 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
