Petitioner, already in custody, seeks bail in connection with Nokha P.S.Case No. 97 of 2017, registered under Section 120 (B) of the Indian Penal Code and Section 25 (1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner seeks bail on the ground of parity as similarly situated co-accused, Mahavir Yadav and Akhilesh Kumar @ Akhilesh Kumar Chaudhary have been admitted bail by Co-ordinate Benches of this Court vide orders dated 09.02.2018 and 12.12.2017 passed in Cr. Misc. Nos. 8070 of 2018 and 58369 of 2017. Further submission is that neither the petitioner was put on Test Identification Parade nor any incriminating article recovered from possession of the

Patna High Court Cr.Misc. No.12863 of 2018 (2) dt.05-03-2018 2/2 petitioner and he is in custody since 18.05.2017. Having considered the said facts and circumstances, the petitioner, Chunmun Singh @ Chunmun Yadav, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram (Rohtas) in connection with Nokha P.S.Case No. 97 of 2017.
