ANJANA MISHRA ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 24.07.2019, in connection with Excise Case No. 159 2018 arising out of Chousa P.S. Case No. 86 of 2018 for the offenses under Sections 147, 148, 149, 323, 307, 353 of Indian Penal Code and Section 25(1-B)a 26, 27, 35 of Arms Act and 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus in nature and he has been falsely implicated in the instant case on the basis of the statement made by one co-accused Nanhku Singh which has no evidenciary value. It is further submitted that no recovery of either illegal wine or any article was made from the

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Madhepura, in connection with Excise Case No. 159 of 2018 arising out of Chousa P.S. Case No. 86 of 2018.
