Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420 and 120B/34 of the Indian Penal Code.
The employees of CMS Info System Limited were going to load Rs.42,00,000/- in different ATMs on behalf of different banks as per their agreement. The driver was Mr. Sampat Sharma and the petitioner was guard on the said vehicle. One Subhash Kumar reported to the police that the money has been looted away by unknown criminals. During investigation, the police found that Mr. Subhash in conspiracy with the driver and this security attempted to misappropriate the aforesaid amount. 12. Further submission is that the petitioner has got no criminal antecedent.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kishanpur Police Station Case No. 352 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
