JUSTICE ARUN KUMAR ORAL ORDER 21-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Budhuchak PS Case No. 30 of 2016 registered under Sections 376/34 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.

The allegation in brief is that the petitioner sexually exploited the prosecutrix for the last one year on the promise to marry with her.

It is contended that the petitioner has falsely been implicated as the marriage negotiation with the prosecutrix failed, the girl is major one and the petitioner is in custody since 22.10.2017. Having considered the said facts and circumstances, the petitioner, namely, Gopal Mandal is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XIII Bhagalpur in connection with Budhuchak PS Case No. 30 of 2016.
