The petitioners seek bail in a case instituted for the offences under Sections 341, 323, 324, 325, 307, 354A, 34 of the Indian Penal Code.

The prosecution case in short is that the accused persons misbehaved with the informant and also assaulted her. It has been submitted on behalf of the petitioners that the petitioners are in custody since 7.7.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been

Patna High Court CR. MISC. No.62701 of 2019(3) dt.27-11-2019 2/2 submitted in the present case. As per the allegation, the injury caused by petitioner nos. 1 and 2 is on leg and forearm. The same is non-vital part of the body. So far petitioner no. 3 is concerned, there is no allegation of assault alleged against him. Since the injuries are on non-vital part of the body, no offence under Section 307 IPC is made out.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -V, Rosera, Samastipur in connection with Singhia P.S. Case No. 101/2019.
