Petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 146 of 2022 registered for the offence(s) punishable under Section(s) 411, 413, 414/34 of the Indian Penal Code.

As per the prosecution, the police personnel while vehicle checking apprehended this petitioner along with other co-accused persons and recovered two motorcycles and three master keys used to unlock motorcycles from their possession. The main submissions advanced by the learned counsel for the petitioner are that similarly situated co-accused Suraj Kumar Sharma @ Bahira @ Aditya Anurag has been

Patna High Court CR. MISC. No.71618 of 2022(2) dt.03-04-2023 2/2 granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 48835 of 2022 and the said co-accused has also criminal antecedent of five cases like the petitioner. Further submission is that the petitioner has been languishing in jail since 17.02.2022 and he has been charge-sheeted and he is a very young person.

Learned APP appearing for the State has opposed the bail prayer.

In view of the facts, as stated above, and mainly considering the petitioner's young age as well as privilege of bail having been granted to co-accused as mentioned above and also his custody period, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Kankarbagh P.S. Case No. 146 of 2022.
