JUSTICE MADHURESH PRASAD ORAL ORDER 12-04-2018 Heard counsel for the petitioners and APP for the State. Petitioners are accused in a case registered for offence under sections 304B and 120B of the IPC.
Petitioner no.1 is the father-in-law of the deceased and petitioner no.2 brother of petitioner no.1. Learned counsel for the petitioners submits that the petitioners are of clean antecedent and have falsely been implicated in the instant case on the basis of general and omnibus allegation and husband of the deceased has been taken into custody on 17.3.2018. Petitioners are in custody in connection with this case since 12.10.2017. Similarly situated coaccused have already been granted bail vide order dated 27.2.2018, passed in Cr Misc No. 10483 of 2018. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let both the petitioners above named
Patna High Court Cr.Misc. No.13533 of 2018 (3) dt.12-04-2018 2/2 be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Mufassil Police Station Case No. 543 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners.
(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
