The petitioner seeks bail in connection with Saur Bazar P.S. Case No. 77 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 74, 303(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

That the prosecution case, in brief, is that on 12.03.2025 at about 7:00 A.M., a dispute arose over cattle grazing in the informant's wheat field, whereupon the accused persons, including the petitioner, assaulted the informant and his family members. It is alleged that petitioner along with other coaccused assaulted Ashok Sah and Shambhu Sah on their heads with an iron Khanti, causing them to fall unconscious. It is

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.07.2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case due to village rivalry and cattle grazing dispute. There is no specific allegation against the petitioner. There is case and counter case between the parties. Injuries of the injured persons are found to be simple in nature. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties
