This is a case registered under Sections 457 and 380 of the Indian Penal Code.

Petitioner's counsel submits that merely because of his criminal antecedent, though he is on bail in four cases pending against him details of which have been disclosed in Para 3 of the bail application, he has falsely been implicated in this case and he is in custody in connection with this case since 19.01.2018. Till date neither TIP has been held and nor alleged stolen mobile has been recovered from the petitioner's possession. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be

No.13640 of 2018 (3) dt.12-04-2018 released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in Motihari Town P.S. Case No. 100 of 2015 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
