The petitioner seeks bail in Lakhisarai P.S. Case No. 481 of 2017 registered under Section 272/273 of the Indian Penal Code and Section 30 (a), 32 (c) and 38 (a) of the Bihar Prohibition and Excise Act, 2016.
230 liters of country made liquor is said to have been recovered from the Scorpio and its driver Phulo Yadav and three ladies sitting on the said vehicle including the petitioner were apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. She happens to be
Patna High Court Cr.Misc. No.13350 of 2018 (02) dt.07-03-2018 2/ 2 lady and simple commuter of the said vehicle and had no knowledge of keeping of the said liquor in the said vehicle. She has been falsely implicated in this case. She has no criminal antecedent. She has been languishing in custody since 26.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge Excise, Lakhisarai in connection with Lakhisarai P.S. Case No. 481 of 2017.
