JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/447/ 323/307 / 302/504 of the Indian Penal Code and Section 27 of the Arms Act. The allegation of firing and of commission of firearm injury is against other named accused persons in the FIR. Only allegation against the petitioner is of commission of assault with lathi.

It appears that co-accused Madan Rai and others have already been allowed bail by a coordinate Bench of this Court vide Annexure-2.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.16201 of 2018 (2) dt.21-03-2018 P2/ Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sugouli P.S. Case No.293 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
