2. Heard learned counsel for the petitioner and learned APP for the State
3. The petitioner apprehends his arrest in connection with Complaint Case No. 320 of 2023 registered for the offences punishable under Sections 341, 323, 504, 498 (A) of Indian Penal Code but vide order dated 26.09.2024 the learned CJM Sheohar took cognizance under Section 498 (A) of I.P.C against the sole petitioner only.

4. As per the prosecution case, petitioner is addicted to drink and he assaulted the complainant (wife of the petitioner) for sake of two lakhs rupees.
5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition.
6. Learned counsel for the State opposes the prayer for bail of the petitioner.
7. From perusal of the complainant petition, impugned order and materials available on record it appears that re-conciliation was conducted in trial Court during reconciliation the complainant said she does not want to live with the petitioner because the petitioner has performed second marriage and he always assaulted her. It is also clear from the compliant petition that marriage between the petitioner and the complainant is solemnized since 20 years ago.
8. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on
Patna High Court CR. MISC. No.69266 of 2025(3) dt.15-11-2025 3/3 bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sheohar in connection with Complaint Case No. 320 of 2023 subject to the condition laid down under Section 482(2) of BNSS.
