The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468, 471, 406 and 120B of the Indian Penal Code.

Allegation against the petitioner is that he took loan of Rs.50,000/- from Punjab National Bank on the basis of false land possession certificate.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner had taken loan of Rs.50,000/- after submitting a land possession certificate in the name of his father. The said loan

Patna High Court Cr.Misc. No.45501 of 2017(2) dt.22-09-2017 2/2 amount has already been returned back by the petitioner. Hence, no wrongful gain or wrongful loss has been caused by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeshwar, Judicial Magistrate, 1st class, Bhojpur in connection with Narayanpur P.S. case No.23 of 2005, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
