"1. That this is an application for issuance of an appropriate writ, order or directions to the Respondents to allow mutation of his lands bearing Khata No.165, Plot No. 201(Old), 636 (New) Area-1 Katha 3 Dhur, Mauza-Nawada, Anchal- Madhepur, District- Madhubani in view of the order passed by Dy. Collector Land Reforms (Respondent No.3) on 03.10.2024 in Mutation Appeal No. 385/2023-24 by which learned Respondent No.3 remanded the Mutation Case No.529 R27/2021-22 for the re-hearing the case and passing fresh order and further to pass any other order or orders to which the petitioner found

2. Mr. Akash Chaturvedi, learned counsel for the petitioner and Mr. Rewti Kant Raman, learned AC to SC-11 for the State-respondents, are present and they are heard.

The main grievance raised by the petitioner in this petition is that the Mutation Case No. 529 R27/2020-21 is not being decided by the Circle Officer, Madhepur, Madhubani (respondent No. 4) despite an order having been passed by the Dy. Collector Land Reforms, Jhanjharpur, Madhubani (respondent No. 3) on 03.10.2024 in Mutation Appeal No. 385/2023-24. Though the issue raised by this petitioner is premature for consideration by this Court under Article 226 of the Constitution of India, however, the respondent No. 4 is directed to expedite the Mutation Case No. 529 R27/2020-21 which is pending before him since 03.10.2024 and conclude the same at the earliest preferably in the next three months from the date of receipt or production of a copy of this Court's order.

4. Accordingly, with the above direction, the instant writ petition stands disposed of.
