JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bihar P.S.Case No. 18 of 2018 registered under Sections 323, 379, 406, 411, 420, 504, 506, and 414/34 of the Indian penal Code.

Allegation in brief is that informant asked the petitioner to help in withdrawing money of Rs. 10000/- from ATM and he handed over the ATM card but more transaction took place than the money was withdrawn by the petitioner and later on recovered from his possession.

Submission is that recovered money is his personal money and allegation is not true and petitioner has no criminal antecedent, besides this he is in custody since 18.01.2018. Having considered the aforesaid facts and circumstances,

No.14813 of 2018 (2) dt.15-03-2018 2/2 the petitioner, namely, Raj Kumar Mistry, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda Biharsharif in connection with Bihar P.S. Case No. 18 of 2018 with condition that he shall not indulge in similar type of activity otherwise bail bond shall be liable to be cancelled.
