JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-06-2020 Heard Mr. N.K.Agrawal, learned senior counsel appearing for the petitioner as well as Ms. Anita Kumari, learned Additional Public Prosecutor for the State through video conferencing.

Petitioner seeks bail in connection with Forbesganj P.S. Case No. 154/2018 registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier, prayer of bail of the petitioner was rejected by a co-ordinate Bench of this Court vide order dated 27.9.2018 passed in Cr. Misc. No. 53167 of 2018 but submission on behalf of the petitioner is that the name of this petitioner came in confessional statement of co-accused Vijay Marandi, who has already been granted privilege of bail and except the petitioner,

Patna High Court CR. MISC. No.63950 of 2019(4) dt.03-06-2020 2/2 almost all the co-accused have been released on bail. He, further, submits that except the confessional statement of coaccused Vijay Marandi, there appears to be nothing against the petitioner, who is languishing in jail custody since 13.3.2018 and in view of the letter No. 2/2020 dated 22.01.2020 of learned trial court, it would appear that there is no likelihood of conclusion of trial of the petitioner in near future. Although, learned Additional Public Prosecutor opposed the prayer but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, 4th , Araria/concerned court in connection with Sessions Trial No. 235/2018 arising out of Forbesgunj P.S. Case No. 154/2018.
