2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No.167 of 2024 registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

3. As per the prosecution case, the daughter of the informant was married with the petitioner about 12 years ago and they were blessed with three children out of their wedlock.

Patna High Court CR. MISC. No.74899 of 2024(3) dt.18-12-2024 2/3 The allegation is that the accused petitioner and in-laws of the deceased killed her for non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the marriage of the victim was solemnized about 12 years ago and from their marriage, they have blessed with three children and earlier there was no complaint against the petitioner that he has demanded dowry or torturing victim. The post-mortem report shows that the death was caused due to the hanging. It appears that it is case of suicide by the victim. The petitioner was not present at the time of alleged occurrence. After investigation, the charge-sheet has been filed against the petitioner in this case. The petitioner is in jail custody since 04.06.2024. The petitioner has no criminal antecedent and he undertakes to co-operate in the trial.

5. Learned APP for the State has opposed the prayer of the petitioner for bail.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief
