Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Sakatpur P.S. Case No.62 of 2022 registered for the offence punishable under Section 379 of the Indian Penal Code. As per the prosecution, the informant's motorcycle was stolen by unknown miscreants from the alleged place. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has been languishing in jail since 03.08.2022, the stolen motorcycle was

Patna High Court CR. MISC. No.69036 of 2022(2) dt.17-03-2023 2/2 recovered near the house of petitioner as per the prosecution and the same was not recovered from the conscious possession of the petitioner and the petitioner has fair and clean antecedent and against him the investigation has been completed and the alleged offence is triable by the Court of Magistrate. Learned APP appearing for the State has opposed the bail prayer.

In view of the facts, as stated above, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sakatpur P.S. Case No.62 of 2022 .
