The petitioners apprehend arrest in connection with Uphara P.S. Case No. 06 of 2017 registered under Sections 304B/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners, who happen to be Bhaisur and Gotni of the deceased, are innocent and have falsely been implicated in this case. On perusal of Annexure P-3 and P-4, it appears that similarly situated co-accused persons have already been allowed bail by different Benches of this Court vide Cr. Misc. Nos. 24868 of 2017 and 36487 of 2017.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.44973 of 2017 (3) dt.09-11-2017 2/2 case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad in connection with Uphara P.S. Case No. 06 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
