====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. Prosecution case, in brief, is that on 10.03.2025 at about 7 PM, when informant was returning home with her family members after visiting Mahmada Fair, all the F.I.R. named accused persons, including this petitioner, assaulted informant and co-accused Sujeet Singh opened fire upon her as a result of which, she sustained firearms injury.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific
Patna High Court CR. MISC. No.67058 of 2025(2) dt.23-09-2025 2/2 accusation of causing firearms injury is against co-accused Sujeet Singh. Petitioner is only alleged to be member of mob and there is no specific allegation of overt act against him.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 8th, Motihari, East Champaran in connection with Pakaridayal P. S. Case No. 76 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
